1. Acceptance of Terms

By accessing or using SwiftCache services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Service Description

SwiftCache provides managed Redis hosting services ("Services"). We offer various subscription tiers with different resource allocations, features, and support levels as described on our pricing page.

3. Account Registration

To use our Services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old
  • Accept full responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. Acceptable Use Policy

You agree not to use our Services to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware, viruses, or harmful code
  • Conduct denial-of-service attacks
  • Attempt to gain unauthorized access to our systems
  • Resell or redistribute our Services without authorization
  • Store illegal content or personally identifiable information without proper safeguards
  • Use our Services for cryptocurrency mining

5. Fees and Payment

5.1 Subscription Fees

Fees are based on your selected subscription tier and are billed monthly or annually in advance. All fees are non-refundable except as required by law or as specified in our refund policy.

5.2 Payment Processing

Payments are processed through Stripe. You authorize us to charge your payment method for all fees incurred.

5.3 Late Payments

Failed payments may result in service suspension. We reserve the right to charge a late fee of 1.5% per month on overdue amounts.

5.4 Price Changes

We may change our pricing with 30 days notice. Continued use after price changes constitutes acceptance.

6. Service Levels and Uptime

We strive to maintain high availability as specified in our Service Level Agreement. However, we do not guarantee uninterrupted service and are not liable for downtime except as specified in the SLA.

7. Your Data

7.1 Data Ownership

You retain all rights to data you store in SwiftCache. We do not claim ownership of your data.

7.2 Data Protection

We implement security measures to protect your data, but you are responsible for maintaining appropriate backups.

7.3 Data Deletion

Upon termination, your data will be deleted within 3 months. You are responsible for exporting any data you wish to retain.

8. Bandwidth and Resource Limits

Each subscription tier includes specific resource limits (memory, connections, bandwidth). We monitor usage and will notify you when approaching limits. Consistent overuse may require upgrading to a higher tier.

9. Intellectual Property

SwiftCache and all related trademarks, logos, and content are our property. You may not use our intellectual property without written permission.

10. Warranties and Disclaimers

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SwiftCache from any claims arising from your use of our Services or violation of these Terms.

13. Termination

13.1 By You

You may terminate your account at any time through the dashboard. No refunds will be provided for prepaid fees.

13.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for non-payment.

13.3 Effect of Termination

Upon termination, you lose access to your instances and data. Provisions regarding data deletion, limitations of liability, and indemnification survive termination.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or dashboard notification 30 days in advance. Continued use constitutes acceptance of modified Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
